Credited in full if the scope agreement is signed within 30 days of plan delivery.

How a job runs

1. You state the purpose and distribution in writing. Who will read what I write, and what it should cover or avoid.
2. Fix plan. The agreed public-storefront assessment and fixed quote arrive within 3 business days of the agreed start date. Payment is due before that date.
3. Scope agreement and deposit. The agreement sets the price, pages and workflows in scope, exclusions, start date and delivery deadline. Work starts on the agreed date after signature, the 50% deposit and required access.
4. Access. Your client approves a Shopify Partner collaborator request. I never ask for their password.
5. Fixes in a theme copy. Nothing changes on the live store while I work.
6. Retest and report. Each fix is retested with axe, the keyboard and a screen reader, and recorded in the report.
7. Your client publishes. Your client, or their developer, reviews the copy and makes it live. Delivery covers the theme copy and report; any post-publication check and the period for reporting issues with delivered fixes are specified in the scope agreement before payment.

Does your client already have a developer or agency? I can review what remains unresolved and quote a fixed price for it, working with them rather than around them. I take one fix plan at a time; if one is in progress, you get a start date before anyone pays.

Confidentiality and data handling

Before preparing a summary or report, I confirm its purpose and authorized recipients with counsel in writing, whoever pays.

• I keep verified behavior separate from what the complaint alleges.
• I do not mark any document as privileged. You decide how it is treated and who receives it.
• Working notes and screenshots exist from the first inspection and are stored on an encrypted disk. Summaries, reports and supporting evidence are shared only with the recipients counsel authorizes, which may include the client and their developer. Beyond an initial observation sent to counsel, I send no further findings without that direction.
• If no engagement follows, I delete them after 90 days. On your instruction, I delete them sooner or preserve them.
• I never contact your client, its customers or the plaintiff's counsel unless you introduce me.

What I do not do

• Legal advice

  I report what the code does and what I changed. Legal questions stay with you.

• Compliance guarantees

  No report of mine says a store is "compliant" or protected from further suits.

• Code I cannot reach

  Shopify's checkout and third-party apps sit outside theme code. Where an app can be patched from the theme, I quote it separately as a workaround; otherwise the report lists it for your client to raise with the vendor.

Terms

Contracting party

I contract as Tony Bach, an individual contractor. The contract names the party you identify, usually your client, and I invoice whoever you name as the payer.

Payment schedule

The $299 fix plan is paid before its agreed start date. Remediation is 50% on signing the scope agreement and the balance on delivery of the report, by US bank transfer (ACH or wire) or by card through PayPal.

Fix-plan credit

The $299 comes off the remediation balance if the scope agreement is signed within 30 days of plan delivery. The $1,500 minimum applies before the credit. One credit per plan. For a $3,000 remediation quote with an eligible credit: $299 for the plan, a $1,500 remediation deposit, and $1,201 on delivery. The total paid is $3,000.

Fixed price

The quoted price covers the agreed scope. Work outside the agreed scope is added only by a written change that the contracting party approves.

Liability

My total liability is limited to the fees paid for the engagement.

Outcome

The work reduces the accessibility barriers found in scope. It does not guarantee compliance, a settlement or a dismissal.
